At FSG, our Employment & Labor Practice Group represents management in all aspects of employment counseling and litigation.  We serve clients engaged in diverse industries such as apparel (including numerous surfwear companies) retail, health care, banking, pharmaceutical, research and development, computer hardware manufacture and software development, recreation, entertainment, and construction on the local, national, and international level.

With extensive experience representing employers in state and federal court litigation including sexual harassment, discrimination, and wrongful discharge claims, our attorneys have been particularly successful in convincing plaintiffs and their attorneys to abandon cases without payment or to settle matters for nominal sums.  In equal employment matters, our attorneys have defended numerous single plaintiff suits and have represented employers in multi-plaintiff cases and in class actions.  Our attorneys have defended employers against claims of discrimination including those based on sex, age, race, disability and other protected categories, throughout California and other states including Alabama, Arizona, Colorado, Connecticut, Georgia, Hawaii, Nevada, New Hampshire, New York, Oregon, Texas, and Washington.

The Employment & Labor Practice Group also represents management in arbitrations and before governmental agencies with jurisdiction over the employment relationship, including the United States Department of Labor, the Equal Employment Opportunity Commission, the California Division of Labor Standards Enforcement, the California Fair Employment and Housing Commission, the Workers’ Compensation Appeals Board, the National Labor Relations Board, and the Unemployment Insurance Appeals Board. Our Employment & Labor Practice Group regularly represents employers during audits and in litigation brought by state and federal agencies enforcing wage and hour laws and regulations.

In addition to our litigation and administrative law practice, our Employment & Labor Practice Group attorneys draft employee handbooks and work with our clients’ management teams in the development and implementation of personnel policies and practices.  Our attorneys routinely counsel clients on all aspects of the employment relationship including hiring, compensation, bonus structures, discipline, and termination generally and in specific employee situations. Our attorneys also advise clients on resisting union organizing drives, avoiding unfair labor practice charges, and dealing effectively with strikes, picketing, and boycotts.
