FSG’s Real Estate & Construction Practice Group represents real estate owners, developers, investors, landlords, tenants, managers, borrowers, contractors/subcontractors, construction managers, lenders, title companies, brokers, architects, engineers and other real estate service providers in the structuring, negotiating and closing of transactions that involve the acquisition, disposition, development, leasing, and construction of all real property types.
Our Real Estate & Construction Practice Group attorneys have extensive experience in all aspects of real estate transactions. We represent buyers, sellers, brokers and developers in all types of purchase and sale transactions from large residential, commercial or industrial projects to individual home purchases and sales. Structurally, these projects can include multi-party endeavors such as joint ventures and strategic alliances, involving syndications, equity investments or other financing arrangements. We are highly experienced in real property-related tax matters, which include tax-deferred exchanges.
FSG attorneys are also experienced in negotiating and preparing retail, commercial, office and industrial leases, lease assignments and terminations. We work closely with developers, engineers, architects and planners to obtain municipal zoning and land use entitlements for residential, commercial, industrial, office and mixed-use developments. FSG’s Real Estate & Construction Practice Group also represents lenders and borrowers in preparing and reviewing loan documents for financing of all types of commercial and residential real estate projects, including bank financing through mortgages, construction loans, seller financing through land contracts and purchase money mortgages, and distressed real estate projects. We also provide valued assistance in loan workouts and foreclosures.
The FSG Real Estate & Construction Practice Group has extensive experience handling all aspects of major public and private construction projects, including bidding, contracting, negotiation, mediation, arbitration and litigation. We regularly assist our clients in the selection and implementation of project delivery methods such as traditional lump sum and cost plus contracts, design/build, construction management and fast-track. We also assist with the formation and negotiation of contracts, project financing and bonding, claims for defective work, delay claims, lien claims, equitable adjustments and foreclosure proceedings.
FSG attorneys have experience in a wide range of real estate dispute resolution processes such as arbitration, mediation and litigation, including disputes between sellers and purchasers, boundary disputes, quiet title actions, adverse possession claims, environmental liability and riparian rights issues.
